Terms & Conditions

1. THE AIRWAY BILL

• Sunrise International Courier & Cargo waybill is non-negotiable and acknowledges the receipt prepared by the company or on behalf of the shipper
• The shipment accepted by Sunrise International Courier & Cargo through an airway bill shall cease on receipt of acknowledgment received by the consignee for the shipment by attaching signature on the delivery sheet or original copy on return.
• The shipment included under the airway bill shall be the sole risk of the owner.

2. SHIPPER OBLIGATION AND ACKNOWLEDGMENT :

• The shipper on booking materials for shipping through Sunrise International Courier & Cargo gives their consent for terms and conditions as stated here.
• As a result of this, the shipper warrants ownership and authority of goods transported and acknowledges the terms and conditions for itself and/or as an agent or on behalf of another person with interest in the material shipped.
• The shipper also shall warrant every article mentioned in the shipment is proper and defines the waybill. Furthermore, it does not contend with the provision as mentioned by the Indian Post Office or other law for the said period and non-declaration by Sunrise International Courier & Cargo to be unacceptable for transport as mentioned under section 12. It agrees the shipment is marketed, addressed, and packed to ensure safe handling.
• The user shall be solely liable to all costs and expenses (including octroi, state, local taxes, and imports) covering the entire cost of shipment incurred while returning the shipment to the company or for warehousing the shipment to be returned.
• The shipper with this accepts all the conditions mentioned, including the shipment is transported by Sunrise International Cargo & Couriers from the point of pickup only to the address as mentioned in the waybill. In situations where the shipment needs to be redirected/ re-routed or returned, the shipper shall pay in advance charges as levied for redirecting and return by Sunrise International Cargo & Couriers.
• The return of material in accordance with the normal schedule of Sunrise International Cargo & Couriers as also any state local taxes, octroi, imports, etc. as applicable thereon, Sunrise International Cargo & Couriers shall hold such shipment at the destination as per the date on the waybill for a maximum of 10 days from the shipment date. Hereafter, Sunrise International Cargo & Couriers reserves the right to destroy the shipment material without prior notice to the shipper. The shipper shall not indemnify Sunrise International Cargo and Courier against any claim or liability.
• Packing of the shipment will be the sole onus of the shipper and material placed inside the containers supplied by Sunrise International Cargo & Couriers.

3. SUNRISE INTERNATIONAL COURIER & CARGO RIGHTS OF INSPECTION OF SHIPMENT :

• Sunrise International Cargo & Couriers holds the sole right and no obligation to inspect or open the shipment.
• Furthermore, it reserves the rights to refusal for accepting shipment not confirming the terms and conditions without a sign for any reason

4. INSURANCE :

• The shipper shall insure his shipment materials at his own cost if deemed necessary

5. OCTROI :

• Costs applicable at the time of shipment, including control sales tax or duties, shall be paid by the consignee when the shipment is delivered. Sunrise International Cargo & Couriers preserves the rights on all its shipments until its duties are paid completely regarding octroi freight, taxes, and other charges levied.

6. CHARGEABLE WEIGHT :

• All shipments will be charged based on the chargeable weight defined under and not the actual weight of the material. The rates of chargeable weight will be greater to the (a) the original weight rounded to the next higher half/ one kg as per the price category agreed or (b) the total volume weight rounded as per the calculation of (a)
• The total volume weight of the shipment in kilogram is calculated as per the gross cubic volume in cubic centimeter dividing it by 5000

7. LIEN ON GOODS SHIPPED :

• Sunrise International Cargo & Courier shall be liable for the goods shipped under all freight charges, octroi of state and local taxes in advance, and charges arising on transport hereunder. Furthermore, we reserve the rights to non-surrender of goods until the charges are entirely paid.

8. LIMITATION OF LiABILITY :

• In terms of Section 9 and 10, the total cost of liability by Sunrise International Cargo & Courier for any loss or damage incurred during shipment (inclusive of terms like parcels or documents consigned W.E.S.) will not be higher to (a) Rs 500 (b) the total cost of damage or loss to the parcel or document sustained or (c) value of the parcel or document determined excluding the commercial utility of the shipper.
• The total values of the parcel or document will be (contained as per the reference t cost or preparation in accordance to the preparation of reconstruction or replacement value and shipment location but shall not exceed Rs 500.
• The total parcel value (the terms shall include materials of commercial value that is transported) will be ascertained in reference to the resale or replacement or fair market value, which shall not exceed the actual cost of the article paid by the shipper shall be under the limit of Rs. 500

9. CONSEQUENTIAL DAMAGES EXCLUDED :

• Sunrise International Cargo & Couriers will not be liable under any event for special damages or consequential or direct or indirect laws arising howsoever or not as acknowledged by Sunrise International Cargo & Couriers for damages incurred including but not solely limited to the loss of profits, interest, income, loss of market or utility.

10. LIABILITIES IS NOT ASSUMED :

• Sunrise International Cargo & Couriers shall not be liable for any damage or loss of shipments or any delay in delivering and pickup.
• It includes:
• Acts of God force or occurrence of any calamity that is beyond the control of Sunrise International Cargo & Courier, loss or damage incurred due to strike or riots or political disturbances, including fire or explosion beyond the control of the company that may be caused by
  • The commission or fault of the shipper, third party, or consignee claiming an interest in the material shipped (violating terms/ conditions) thereof
  • Carrier mode including airways or airlines not abiding to the schedule for any reason
  • Discharge of official duties by government officials, including taxation/ customs/ octroi inspection, etc.
  • Magnetic or electrical injury, damage to photographic images, or audio recording of any kind
  • Nature of shipment showing any inherent defects or thereof.
• The shipper herein indemnifies Sunrise International Cargo & Couriers for any damage, penalty, proceedings, loss or actions, etc., instituted by government officials on the discharge of their official duties, including Octroi inspection/ taxation or customs, etc.
• Inclusive of the above statements, Sunrise International Cargo & Couriers shall deem to exercise prompt delivery of materials as per the regular delivery. However, Sunrise International Cargo & Couriers shall not be liable for the delay in transportation or pickup or shipment delivery regardless of the reason for such delays.

11. RETURN FREIGHT CHARGES & DUES FOR RTO SHIPMENT :

• The shipper shall be solely liable for charges surrounding clearance/ taxes/ warehouse/ import duty, etc., at the destination on the refusal of payment by the consignee. All the dues and charges, along with DDP charges, shall be paid by the shipper at the destination.
• In case of non-delivery of shipments at the location, the materials will be returned to the origin or destroyed without any notice. The charges of return freight and destroy charges shall be paid by the shipper in line with the company's tariff, including all dues.

 12. CLAIMS :

• All claims should be brought to notice by the shipper by delivering in writing, addressing the Office of Sunrise International Cargo & Couriers nearest to your location where the shipments are accepted within 15 days from the date of delivery. Sunrise International Cargo and Courier shall accept no claims beyond the set time.
• Loss/ damage/ claim shall not be accepted until the users pay all charges. The amount as mentioned in the claim shall not be deducted from under any charges levied on transportation as part of Sunrise International Cargo & Couriers.

13. MATERIAL NOT TO BE ACCEPTED FOR CARRIAGE :

• Items and materials prohibited or not permitted according to rules/ restrictions/ or laws in force, including blank documents, share transfer forms, or share certificates, shall not be accepted for shipment.
